"What Happens at Settlement Day?"

PURCHASER INSPECTION PRIOR TO SETTLEMENT
The Purchaser is entitled to view the property before settlement by contacting and booking a time with the Agent who will also attend this final inspection.

The Purchaser inspection ensures the property is clean and tidy and no inclusions have been removed from the property, there is nothing worse than taking possession and going to your new home only to find fixtures and fittings you agreed upon are missing. Remember ‘Caveat emptor’

(Let the buyer beware) as matters like this are very hard to resolve after

BROWN AND BROWN RECOMMEND
The course of wisdom is to view the property, either later in the day before settlement, or on the morning of completion.

WHO ATTENDS SETTLEMENT?
Settlement is attended by at least four parties - Vendors & Purchasers Conveyancer/ Solicitor - plus the discharging Mortgagee and incoming Mortgagee.

At the settlement all relevant documents are exchanged i.e. Titles and Bank Cheque to the various parties.

The Purchaser or Vendor is not required to attend the settlement – Brown & Brown Conveyancers do all this for you.

Immediately after settlement - all documents are lodged with the Land and Property Office they produce a new Title and notify different Government Depts of change of ownership.

Keys are collected from the Agents Office and you now can take full possession of your new property.

THE WAY OF THE FUTURE - ONLINE SETTLEMENTS
'Change is in the air'
… It’s interesting to note that by the end of next year it is proposed that most property settlements will be conducted via the internet:

• a physical Title will be done away with;

• all parties will digitally sign documents on behalf of Clients;

• Banks will digitally sign the Mortgage documents on behalf of Borrowers; likewise with Conveyancers;

• identity checks will be mandatory;

• funds will be transferred via the internet to banks; Solicitors trust accounts;

• Council Water and Strata levies paid at settlement via the internet;

• all dealings registered instantaneous at Lands Title office rather than the way it is now having to wait up to 3 or 6 months for new Titles to be registered.

PHYSICAL TITLES vs ONLINE TITLES
The Physical Title or cardboard Title held by Banks was introduced to prevent fraud - now it is increasing fraud because fraudsters are able to produce (forge) Titles better than the Lands Title office, and as some recent cases have shown it is usually family members hooked on gambling who resort to forging titles; although internet fraud is also a problem it is thought that in this instance an Online title will be more secure.
