FIXTURES – WHAT CAN I TAKE FROM HOME?"

All fixtures are included in a Sale of Property.

A fixture is something screwed or nailed to the land or building; cannot be lifted up and taken away without doing damage.

Some items such as water features or large stone lions have been held to be fixtures because they form the overall architectural feature of a home.

As a rule of thumb if it’s wired in it’s a fixture, e.g.
1. most electric ovens are wired in - so they are fixtures;
2. most refrigerators are plugged in - so they are not fixtures.

In the standard Contract – ensure all inclusions are specified – e.g. Dishwasher (no brand name or model number) was swapped by the Vendor for an inferior one prior to settlement – Court held was still a dishwasher.

TIP: best way to protect yourself is to spell out the brand and model number – you do not know the lengths some Vendors will go to between signing the contract and settlement.
